A CÂMARA MUNICIPAL DE ILHÉUS vem a público prestar esclarecimentos acerca da análise e deliberação do Projeto de Lei que visava assegurar o pagamento do 13º salário e das férias remuneradas aos profissionais contratados do Município.
Cumpre, inicialmente, esclarecer que a Comissão de Justiça e Finanças, bem como o Plenário desta Casa Legislativa, não se opõem ao reconhecimento dos direitos sociais em debate. Ao contrário, é expressamente reconhecido que o 13º salário e as férias anuais remuneradas constituem direitos sociais de estatura constitucional, assegurados pelos incisos VIII e XVII do art. 7º da Constituição Federal, sendo instrumentos essenciais à dignidade da pessoa humana e à valorização do trabalho.
A rejeição da proposição, entretanto, decorreu exclusivamente de óbices de natureza jurídico-formal, nos seguintes termos:
1. Iniciativa legislativa privativa do Poder Executivo – Nos termos da Constituição Federal, é de competência exclusiva do Chefe do Poder Executivo a iniciativa de leis que disponham sobre regime jurídico, remuneração e vantagens de servidores públicos ou contratados, bem como aquelas que importem em criação ou aumento de despesas de pessoal (art. 61, §1°, II, CF).
2. Configuração de vício de iniciativa – A apresentação do projeto por iniciativa parlamentar caracteriza vício formal insanável, uma vez que a matéria extrapola a competência legislativa dos Vereadores, tornando a proposição incompatível com o ordenamento constitucional.
3. Matéria de natureza orçamentária – A Comissão de Finanças e de Justiça emitiu parecer oral desfavorável, por se tratar de matéria com repercussão orçamentária e financeira, igualmente sujeita à iniciativa exclusiva do Poder Executivo, à luz das normas de responsabilidade fiscal e do planejamento orçamentário.
Dessa forma, a controvérsia não reside no mérito da proposta ou na legitimidade dos direitos pleiteados, mas, sim, na inadequação da via legislativa adotada. Compete à Câmara Municipal, como órgão do Poder Legislativo, zelar pela estrita observância da legalidade, da Constituição e da separação dos Poderes.
Para que os direitos em questão possam ser validamente instituídos, é imprescindível que a proposição legislativa seja encaminhada pelo Poder Executivo Municipal, detentor da competência constitucional para iniciar leis dessa natureza.
A Câmara Municipal de Ilhéus reafirma, por fim, seu compromisso com a defesa dos direitos dos trabalhadores, sem prejuízo do respeito aos limites constitucionais e legais que regem o processo legislativo e a gestão responsável dos recursos públicos.

A Câmara Municipal de Ilhéus (CMI) vai votar, nesta quarta-feira (17/12), o Projeto de Lei (PL) nº 182/2025, encaminhado à Casa pelo Executivo municipal e que estabelece a Lei Orçamentária Anual (LOA) de 2026. A votação se dará em duas sessões – a primeira será extraordinária, a partir das 14h, e a segunda, ordinária, a partir das 16h.
O PL estima as receitas que serão arrecadadas pelo Município no ano que vem e autoriza a realização das despesas. A apreciação da matéria fecha um processo que contou com duas audiências públicas realizadas pela CMI, para apresentar a proposta à sociedade e ouvir as demandas.
Nas sessões desta quarta-feira, serão apreciadas as sugestões da população, além das emendas propostas pelos vereadores – as impositivas ou não. Ao todo, foram apresentadas pelos edis 291 propostas de emendas ao PL nº 182/2025.
